Terms & Conditions

These Terms & Conditions (the "Terms") are a binding agreement between you and Everywhen Games AB, Anckargripsgatan 3, 211 19 Malmö, Sweden ("Everywhen Games," "we," "us," or "our") governing your use of all of our games and applications (each a "Game" and together the "Games") and our website everywhen.games (together with the Games, the "Services"). They apply to every title we publish, including current and future games. By downloading, accessing, or playing any of our Games you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

01Eligibility

You must be at least the age of digital consent in your country, and meet the age rating shown for the relevant Game, to use it. If you are a minor, you may use a Game only with the consent and supervision of a parent or legal guardian who agrees to these Terms.

02Licence to use the Games

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to download and play our Games on a device you own or control, for your personal, non-commercial entertainment. We and our licensors retain all rights not expressly granted.

03Virtual items and currency

Our Games may include virtual currencies (such as coins or gems), boosters, passes, and other virtual items (collectively, "Virtual Items").

Virtual Items have no real-world monetary value, are not your property, and cannot be redeemed for cash or transferred outside the Game in which they were obtained.
You receive a limited, revocable licence to use Virtual Items within the relevant Game. We may manage, regulate, modify, or remove Virtual Items, and may change game balance, pricing, or availability at any time.
Virtual Items and entitlements are tied to the device/store account that obtained them and may be lost if you delete the app, lose your device, or if your store account is closed. Virtual Items are specific to a single Game and do not carry across titles unless we expressly say so.

04In-app purchases

Our Games may offer optional in-app purchases, including consumable items (such as currency packs and bundles) and non-consumable entitlements (such as "Remove Ads" or seasonal passes).

All purchases are processed by the Apple App Store (or, where applicable, Google Play). Your purchase is also subject to that store's terms. Prices are shown in the store at the time of purchase and may vary by region and over time.
Refunds: except where required by law, all purchases are final. Refund requests are handled by Apple or Google under their policies; we generally cannot grant refunds directly.
You are responsible for any taxes and for charges incurred under your store account, including purchases made by anyone you allow to use your device.

05Advertising

Some of our Games are supported in part by advertising, which may include full-screen (interstitial) and rewarded ads. Where offered, you can remove interstitial ads by purchasing the "Remove Ads" entitlement for that Game. Ads are provided by third parties; we are not responsible for the content of third-party ads or the products or services they promote.

06Acceptable use

You agree not to:

cheat, exploit bugs, use bots, or use unauthorized third-party software to gain an advantage or to obtain Virtual Items without paying;
reverse engineer, decompile, modify, or create derivative works of any Game, except where this restriction is prohibited by law;
access the Games through unofficial means, or tamper with security, billing, or save data;
infringe our or others' intellectual property, or use the Services unlawfully; or
resell, rent, or commercially exploit any Game or Virtual Items.

We may suspend or terminate access for violations.

07Intellectual property

Our Games and all related content, including artwork, characters, audio, text, code, and the "Everywhen Games" name, our game titles, and logos, are owned by Everywhen Games or its licensors and are protected by intellectual-property laws. You receive only the limited licence described in these Terms.

08Updates and availability

We may update, change, or discontinue any Game (or any feature, Virtual Item, or event) at any time, and we do not guarantee uninterrupted availability. Some features require an internet connection and a compatible, up-to-date device.

09Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Some jurisdictions do not allow certain disclaimers, so some may not apply to you.

10Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVERYWHEN GAMES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN CONNECTION WITH THE RELEVANT GAME IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $50.

Nothing in these Terms limits liability that cannot be limited under applicable law.

11Indemnification

You agree to indemnify and hold harmless Everywhen Games from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Services or violation of these Terms or applicable law.

12Termination

You may stop using any Game at any time by deleting it. We may suspend or terminate your access if you violate these Terms or where required by law. Sections that by their nature should survive termination (including Sections 3, 7, 9, 10, 11, and 14) will survive.

13Apple App Store additional terms

For Games downloaded from the Apple App Store, these Terms are between you and Everywhen Games, not Apple. Apple is not responsible for the Games or their content. Apple has no obligation to provide maintenance or support for the Games. In the event of any failure of a Game to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the Games, including product-liability, legal/regulatory, or intellectual-property claims. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. prohibited-parties list. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

14Governing law and disputes

These Terms are governed by the laws of Sweden, without regard to conflict-of-law rules. The courts of Malmö, Sweden will have jurisdiction, except where mandatory applicable law (including EU consumer-protection law) gives you the right to bring proceedings in, and to rely on the consumer laws of, your country of residence. Nothing in these Terms affects your statutory rights as a consumer.

15Changes to these Terms

We may update these Terms from time to time, including as we release new Games. We will post the updated version here with a new "Last updated" date and, where required, provide additional notice. Continued use of the Services after changes take effect constitutes acceptance.
